A. A school district, charter holder or private residential facility that elects to provide at least two hundred days of instruction may increase its base level by five percent. A school district, charter holder or private residential facility that elects to provide at least two hundred days of instruction shall obtain approval from the department of education before the beginning of the fiscal year that the school district, charter holder or private residential facility is planning on offering instruction for at least two hundred days. The school district, charter holder or private residential facility shall ensure that the last day of instruction in any school year occurs before June 30. The school district, charter school or private residential facility shall increase its annual instructional hours by at least ten percent in order to receive the base level increase prescribed in this section.
B. For the purposes of this section, “private residential facility” has the same meaning prescribed in § 15-1181.
