If through judicial review of a decision or order regarding an administrative penalty it is determined that a violation did not occur or that the amount of the penalty should be reduced or not assessed, the railroad commission shall, not later than the 30th day after the date of that determination:
(1) remit the appropriate amount to the gas utility with accrued interest if the utility paid the penalty to the railroad commission; or
(2) execute a release of the bond if the utility posted a supersedeas bond.
