(a) The commission by rule shall establish reasonable and necessary fees for certification as an inspection station.
(b) The fees established under this section may not be less than:
(1) except as provided by Subdivision (2) or (3):
(A) $100 for certification until August 31 of the odd-numbered year after the date of appointment as an inspection station; and
(B) $100 for certification for each subsequent two-year period;
(2) if an applicant for certification as an inspection station has been convicted of a violation of this chapter relating to an emissions inspection under Subchapter F: 1
(A) $500 for certification until August 31 of the odd-numbered year after the date of appointment as an inspection station; and
(B) $100 for certification for each subsequent two-year period; and
(3) if an applicant for certification as an inspection station has been convicted of two or more violations of this chapter relating to an emissions inspection under Subchapter F:
(A) $1,500 for certification until August 31 of the odd-numbered year after the date of appointment as an inspection station; and
(B) $100 for certification for each subsequent two-year period.
