(a) An advisory committee consisting of nine members shall:
(1) advise the environmental commission and the department on the environmental commission's and department's rules relating to the operation of the vehicle inspection program under this chapter;
(2) make recommendations to the environmental commission and the department relating to the content of rules involving the operation of the vehicle inspection program; and
(3) perform any other advisory function requested by the environmental commission or the department in administering this chapter and Chapter 382, Health and Safety Code.
(b) The members of the commission shall appoint seven members of the committee as follows:
(1) four persons to represent inspection station owners and operators;
(2) one person to represent manufacturers of motor vehicle emissions inspection devices;
(3) one person to represent independent vehicle equipment repair technicians; and
(4) one person to represent the public interest.
(c) The presiding officer of the environmental commission and the presiding officer of the commission shall each appoint one member of the committee who will alternate serving as the presiding officer of the committee.
(d) Committee members serve staggered three-year terms.
(e) A vacancy on the committee is filled in the same manner as other appointments to the committee.
(f) A member of the committee is not entitled to compensation, but is entitled to reimbursement of the member's travel expenses as provided in the General Appropriations Act for state employees.
(g) The committee may elect an assistant presiding officer and a secretary from among its members and may adopt rules for the conduct of its own activities.
(h) The committee is entitled to review and comment on rules to be considered for adoption by the environmental commission, the commission, or the department under this chapter or Chapter 382, Health and Safety Code, before the rules are adopted.
(i) The committee shall hold a meeting at least once each quarter.
(j) Chapter 2110, Government Code, does not apply to the committee.
