(a) The governing body of an alternate municipality, after hearing the evidence presented at the hearing, shall adopt an ordinance creating an authority if the governing body finds that the creation of the authority and the operation of a transit authority system would be:
(1) of benefit to the persons and property in the boundaries of the proposed authority;
(2) of public utility; and
(3) in the public interest.
(b) An ordinance creating an authority must:
(1) contain a description of the territory to be in the authority; and
(2) provide a name for the authority.
(c) After the hearing, the governing body shall submit the proposed plan to the governor's interagency council for transportation for review and comment.
