(a) On request of the Health and Human Services Commission or the Texas Juvenile Justice Department, the department may enter into agreements with either agency for the construction, maintenance, or repair of roads in an institution, hospital, or school under the control, management, or supervision of that agency.
(b) The Health and Human Services Commission or the Texas Juvenile Justice Department may reimburse the appropriate fund of the department for the cost of construction or maintenance performed under Subsection (a). Before a transfer of an amount under this subsection, the reimbursing agency shall notify in writing the comptroller of the amount to be transferred and the fund from which the amount is to be taken.
