(a) The authority may exercise the power of eminent domain inside or outside the authority to acquire the fee simple title to, or an easement or right-of-way over or through, any private or public land, water, or land under water that is necessary or convenient for carrying out any purpose or power conferred on the authority by this chapter.
(b) A condemnation proceeding is under the direction of the board and must be in the name of the authority.
(c) The assessment of damages and all procedures with reference to condemnation, appeal, and payment must conform to Chapter 21, Property Code. (Acts 43rd Leg., 1st C.S., Ch. 63, Sec. 13A-3.)
