The department may deny a person's request to renew a license issued under this chapter if the person has not paid an administrative penalty imposed under Subchapter F, Chapter 51. 1 This section does not apply if:
(1) the person's time to pay or request a hearing has not expired under Section 51.304;
(2) the person has requested a hearing under Section 51.304, but the person's time to pay has not expired under Section 51.307; or
(3) the penalty is stayed.
