Texas Labor Code - LAB § 201.065. Service by Relative

In this subtitle, “employment” does not include:

(1) service of an individual in the employ of the individual's son, daughter, or spouse;  or

(2) service of an individual younger than 21 years of age in the employ of the individual's father or mother.
