(a) The executive director or designated personnel of the department may investigate violations of this chapter and violations of the rules adopted under this chapter. After conducting investigations, the executive director, a person designated by the department, or any law enforcement agency may file a complaint with the district attorney of Travis County or with the district attorney of the county in which a violation is alleged to have occurred.
(b) The executive director has the administrative, enforcement, and collection powers provided by Subtitle B, Title 2, Tax Code, 1 in regard to the lottery. For purposes of the application of Title 2 of the Tax Code:
(1) the state's share of proceeds from the sale of lottery tickets is treated as if it were a tax; and
(2) a power granted to the comptroller may be exercised by the department.
