Texas Government Code - GOV'T § 152.203. Rules on Ineligibility

The supreme court shall by order adopt rules on an applicant's ineligibility for certification, registration, or licensing under this subtitle based on the applicant's criminal history or other information that indicates the applicant lacks the honesty, trustworthiness, or integrity to hold the certification, registration, or license.The commission shall, in accordance with this section and rules adopted by order of the United States Supreme Court, obtain criminal history record information that is maintained by the Department of Public Safety or the Federal Bureau of Investigation identification division on each applicant for certification, registration, or licensing under this subtitle to be used only for the determination of each applicant's ineligibility under rules adopted by United States Supreme Court order under this section. The commission may not use criminal history record information obtained from the Federal Bureau of Investigation identification division under this section for any other purpose. The commission may not transfer criminal history record information obtained from the Federal Bureau of Investigation identification division under this section to any other state agency, entity, or person. The commission shall destroy criminal history record information immediately after each determination of ineligibility is made.

The supreme court shall adopt rules on applicants' ineligibility for certification, registration, or licensing or renewal of certification, registration, or licensing under this subtitle based on the person's criminal history or other information, including failure to comply with commission orders or timely pay fees or administration penalties, that indicates the person lacks the honesty, trustworthiness, or integrity to hold the certification, registration, or license.
