(a) The commission may impose a civil penalty against a person as provided by this subchapter only after a formal hearing as provided by Subchapter E, Chapter 571, Government Code. 1
(b) The commission shall base the amount of the penalty on:
(1) the seriousness of the violation;
(2) the history of previous violations;
(3) the amount necessary to deter future violations; and
(4) any other matter that justice may require.
(c) Repealed by Acts 2019, 86th Leg., ch. 384 (H.B. 3233), § 17(7).
