Texas Education Code - EDUC § 29.042. Establishment and Administration of Program

(a) The agency by rule shall establish and administer a parent-directed program for students receiving special education services through which a parent may direct supplemental services and supplemental instructional materials for the parent's student who meets the eligibility requirements for participation in the program.  Subject to Subsection (c), the agency shall provide each student approved as provided by this subchapter a grant of not more than $1,500 to purchase supplemental services and supplemental instructional materials.  If the agency receives more acceptable applications for a grant for a school year than available funding for that school year, the agency shall place remaining students on a waitlist for the subsequent school year.

(b) In administering the program, the agency shall maintain a system of online accounts to provide access to the grant described by Subsection (a) to an eligible student's parent.

(c) A student may receive one grant under this subchapter unless the legislature appropriates money for an additional grant in the General Appropriations Act.

(d) The agency shall designate one or more regional education service centers to administer the program.

(e) The agency shall maintain an online user-friendly application system for parents to apply for a grant described by Subsection (a).

(f) A regional education service center designated to administer the program under this subchapter for a school year is entitled to receive not more than four percent of the amount appropriated for purposes of making grants under this subchapter for that school year for the costs of administering the program.
