Tennessee Code Title 7. Consolidated Governments and Local Governmental Functions and Entities § 7-70-104

(a) If a utility board is expanded pursuant to this chapter, then the home municipality may:

(1) In consultation with the appointing chief executive officer, establish initial, staggered appointments of two (2) years to ensure consistent and experienced representation, followed by terms of four (4) years that begin on January 1 and end on December 31 of each applicable year; provided, that the first of such terms must be deemed to begin on January 1, 2027, or the January 1 following an electric utility's expansion of service into an outside locality; or

(2) In consultation and agreement with the appointing chief executive officer, establish term lengths, term limits, and term start dates that are similar to, and coincide with, the term lengths, term limits, and term start dates of board members appointed by the home municipality; provided, that the board member begins serving on January 1, 2027.

(b) A board member appointed pursuant to this chapter may be reappointed for successive terms.

(c) A board member appointed pursuant to this chapter serves until their successor is selected and assumes office. In the event of a vacancy, the chief executive officer of the appointing county or incorporated city or town shall appoint a person in accordance with § 7-70-103 to fill the vacancy for the remainder of the unexpired term.

(d) A board member appointed pursuant to this section is subject to the same removal process used for other board members of the utility board; provided, that the chief executive officer who appointed the board member must be given written notice no less than ten (10) business days before removal proceedings occur.
