With regard to a healthcare facility that has been the subject of a change of control as defined by regulation, the board for licensing health care facilities in its discretion may delegate to the commission the authority to issue a new license to the successor owner. The delegation of this authority is limited to circumstances where:
(1) The successor owner meets the qualifications for a license;
(2) The healthcare facility has no outstanding license or certification deficiencies; and
(3) The successor owner already owns or controls at least one (1) other healthcare facility in this state.
