(a) Any municipality within the district, which has connected or connects its sewers with the facilities of the project, shall adopt appropriate rules and regulations, pertaining to sewer usage, no less restrictive than the rules and regulations pertaining to sewer usage so adopted by the commission. The municipal rules and regulations shall include procedures for monitoring and enforcing compliance, and shall be submitted to the commission prior to their adoption. The commission shall have the authority to refuse service or connection to any municipality that fails to comply with this section.
(b) The commission shall retain the authority to seek judicial relief for noncompliance by affected dischargers when any municipality has failed to seek that relief, or when the municipality has acted to seek that relief but has sought a penalty which the commission finds to be insufficient. Nothing in this section shall in any way limit the authority granted the commission under §§ 46-25-25 -- 46-25-25.4.
