(a) All definitions and guidelines for replacement and periodic inspection of tanks shall be developed by the director of the department of environmental management in conjunction with the director's efforts to promulgate regulations for underground storage facilities used for petroleum products and hazardous materials, to be promulgated under the authority of this chapter and chapters 17.1 and 35 of title 42.
(b) The regulations shall require that all federally regulated underground storage tanks used for petroleum products and subject to registration in this state shall be inspected at least once in each thirty-six (36) month period.
(c) Any funds remaining in the underground storage tank replacement revolving loan program account after repeal of § 46-12-30.3 shall be used in accordance with the provisions of subsections (a) and (b) of this section and any rules and regulations promulgated therein.
