The chief of the office of internal audit and program integrity shall have the authority to initiate civil recovery actions. In any case where the office of internal audit and program integrity has discovered fraudulent acts and believes that civil recovery proceedings may be appropriate, the chief may authorize the initiation of appropriate civil proceedings or refer the case to the appropriate state agency for civil recovery.
