Whenever the Department of Highways has heretofore procured, or may hereafter procure, liability insurance to protect employes of the department from claims for personal injuries arising out of acts performed in the course of their official duties, and the insurance carrier has become insolvent or gone into liquidation without making adequate provision for the protection required by the policy, the Secretary of Highways is hereby authorized to pay, subject to the approval of the Attorney General, all or any portion of the amount of any valid final judgment, together with costs which has been or may be recovered against such employe as aforesaid.
