Section 1. The functions, powers and duties of the Department of Labor and Industry with regard to the inspection and licensing of migrant labor camps, as set forth in section 9 of the act of May 18, 1937 (P.L. 654), 1 entitled, as amended, “An act to provide for the safety and to protect the health and morals of persons while employed; prescribing certain regulations and restrictions concerning places where persons are employed, and the equipment, apparatus, materials, devices and machinery used therein; prescribing certain powers and duties of the Department of Labor and Industry relative to the enforcement of this act; and fixing penalties,” and the power and duty to make, alter, amend, and repeal rules and regulations relating thereto, and applying the provisions of section 9, to specific conditions, as set forth in section 12 of the act, 2 are transferred to the Department of Environmental Resources.
Section 2. There are hereby transferred to the Department of Environmental Resources to be used, employed, and expended in connection with the functions, powers and duties transferred by section 1 of this Reorganization Plan, contract obligations, if any, records, files, property, supplies and equipment now being used or held in connection with such functions, powers and duties, and the unexpended balances of appropriations, allocations and other funds available or to be made available for use in connection with such functions, powers and duties.
Section 3. Section 9 of the act of May 18, 1937 (P.L. 654), entitled, as amended, “An act to provide for the safety and to protect the health and morals of persons while employed; prescribing certain regulations and restrictions concerning places where persons are employed, and the equipment, apparatus, materials, devices and machinery used therein; prescribing certain powers and duties of the Department of Labor and Industry relative to the enforcement of this act; and fixing penalties,” is suspended in so far as it conflicts with this Reorganization Plan.
