If any officer, or other person, who is enjoined or required to do or perform anything by this act, shall neglect or refuse to perform the same, he shall, (besides being liable to the party grieved for damages,) be punishable for his neglect or refusal as aforesaid, and likewise for any other misbehavior, abuse of trust, and for any fraud therein, by fine and imprisonment, at the discretion of the court of the proper county.
