Pennsylvania Statutes Title 63 P.S. Professions and Occupations (State Licensed) § 1111. Penalties

(a) Whoever (i) sells or fraudulently obtains or furnishes any nursing home administrator license or aids or abets therein, or (ii) practices as a nursing home administrator under cover of any license or registration illegally or fraudulently obtained or unlawfully issued, or (iii) practices as a nursing home administrator or uses in connection with his name any designation tending to imply that he is a nursing home administrator unless duly licensed and registered to so practice under the provisions of this act, or (iv) practices as a nursing home administrator during the time his license or registration issued under the provisions of this act shall be suspended or revoked, or (v) otherwise violates any of the provisions of this act shall, upon conviction thereof be sentenced to pay a fine of not more than five hundred dollars ($500) or to imprisonment for not more than thirty days, or both, and for a second or subsequent offense shall, upon conviction thereof, be sentenced to pay a fine of not more than one thousand dollars ($1,000) or to imprisonment for not more than ninety days, or both.

(b) In addition to any other civil remedy or criminal penalty provided for in this act, the board, by a vote of the majority of the maximum number of the authorized membership of the board as provided by law, or by a vote of the majority of the duly qualified and confirmed membership or a minimum of seven members, whichever is greater, may levy a civil penalty of up to one thousand dollars ($1,000) on any current licensee who violates any provision of this act or on any person who practices nursing home administration without being properly licensed to do so under this act. The board shall levy this penalty only after affording the accused party the opportunity for a hearing, as provided in Title 2 of the Pennsylvania Consolidated Statutes (relating to administrative law and procedure).
