(a) Within one year of the effective date of this act, the department shall serve written notice on the permittee of record of all gas wells permitted under the Oil and Gas Act 1 and which penetrate a workable coal seam that the permittee must designate his gas well as nonproducing, inoperative or producing as those terms are defined in this act.
(b) The permittee shall report his designation of each gas well within one year of the receipt of the notice provided for in subsection (a).
(c) Any gas well for which the department does not receive a designation from the permittee shall be classified as a nonproducing gas well.
