If any person shall construct or cause to be constructed for use after the effective date of this act, any sewer or other method of drainage from any building or dwelling house for the carrying of sewage, offal, refuse, or other offensive matter, into any portion of any operating or abandoned mine, such person shall be guilty of a misdemeanor and, upon conviction thereof, shall be sentenced to pay a fine not exceeding one thousand dollars ($1,000) and undergo an imprisonment not exceeding one year, either or both, at the discretion of the court.
