(a) Any person violating section 5 of this act 1 shall be guilty of a misdemeanor, and upon conviction thereof be sentenced to pay a fine of not more than one thousand dollars ($1000) and costs and, in default of the payment of such fine and costs, shall undergo imprisonment for not more than two years.
(b) All fines and penalties imposed under the provisions of this section shall be paid into the General Fund of the Commonwealth.
