(a) The department may impose a civil penalty of up to five thousand ($5,000) dollars for a violation of this article.
(b) An insurer or MA or CHIP managed care plan shall be subject to the act of July 22, 1974 (P.L. 589, No. 205), 1 known as the “Unfair Insurance Practices Act.”
(c) The department may maintain an action in the name of the Commonwealth for an injunction to prohibit any activity which violates the provisions of this article.
(d) The department may issue an order temporarily prohibiting an insurer or MA or CHIP managed care plan which violates this article from enrolling new covered persons or enrollees.
(e) The department may require an insurer or MA or CHIP managed care plan to develop and adhere to a plan of correction approved by the department. The department shall monitor compliance with the plan of correction. The plan of correction shall be available to covered persons or enrollees of the insurer or MA or CHIP managed care plan upon request.
