Pennsylvania Statutes Title 35 P.S. Health and Safety § 10231.1302. Criminal diversion of medical marijuana

In addition to any other penalty provided by law, an employee, financial backer, operator or principal of any of the following commits a misdemeanor of the first degree if the person intentionally, knowingly or recklessly sells, dispenses, trades, delivers or otherwise provides medical marijuana to a person who is not lawfully permitted to receive medical marijuana:

(1) A medical marijuana organization.

(2) A health care medical marijuana organization or university participating in a research study under Chapter 19.  1

(3) A clinical registrant or academic clinical research center under Chapter 20.  2

(4) A laboratory utilized to test medical marijuana under section 704.  3
