Pennsylvania Statutes Title 32 P.S. Forests, Waters and State Parks § 5612. Definitions

The following words and phrases when used in this act shall have the meanings given to them in this section unless the context clearly indicates otherwise:

“Available railroad right-of-way.”Any railroad right-of-way that is proposed or approved for abandonment before the Interstate Commerce Commission, the Pennsylvania Public Utility Commission, or other governing agency with jurisdiction in the matter.

“Department.” The Department of Environmental Resources  1 of the Commonwealth.

“Secretary.” The Secretary of Environmental Resources of the Commonwealth.

1 The powers and duties previously vested in the Department of Environmental Resources and the Environmental Quality Board by this statute have been transferred to the Department of Conservation and Natural Resources. See 71 P.S. § 1340.308(b).
