Whenever the courthouse, jail or other building of the county is located upon a public square or common in the city, borough or township, then being the county seat, and a new building is authorized and required to be erected in place of such courthouse, jail or other building, the board of county commissioners may erect such new building upon any other of the public squares or commons of said city, borough or township, or upon any part thereof, if the council of the city, borough or township shall have first consented to such new location for said building.
