In a city governed by the provisions of this part, the act of July 15, 1957 (P.L. 901, No. 399), 1 known as the Optional Third Class City Charter Law, or 53 Pa.C.S. Pt. III Subpt. E 2 (relating to home rule and optional plan government), a beneficiary serving in an elective city office shall not be prohibited from receiving a pension for any month in which the beneficiary does not accept a salary from serving in the elective office.
