Notwithstanding ORS chapter 401, the State Department of Energy in cooperation with the Oregon Health Authority and the Office of Emergency Management shall establish rules for the protection of health and procedures for the evacuation of people and communities who would be affected by radiation in the event of an accident or a catastrophe in the operation of a nuclear power plant or nuclear installation.
