(1) When the Department of Human Services or a type B area agency on aging discloses a file, form or report to the public pursuant to ORS 443.740, 443.765 or 443.767, the department or agency may not disclose information about residents that is protected from disclosure by state or federal law or information that is described in subsection (2) of this section unless the resident has provided a written authorization for disclosure of the information.
(2) This section applies to:
(a) The name of a resident and to demographic or other information that can be used to identify a resident.
(b) Any health information that relates to:
(A) The past, present or future physical or mental health or condition of a resident;
(B) The provision of health care to a resident; or
(C) The past, present or future payment for the provision of health care to a resident.
(3) As used in this section, “resident” means an individual receiving care in an adult foster home.
