(1) Any person who violates any provision of ORS 431A.300 to 431A.325 shall be liable for a civil penalty not to exceed $5,000 for each day of violation, which shall be assessed and recovered in a civil action brought by the Oregon Health Authority.
(2) All civil penalties collected pursuant to subsection (1) of this section shall be deposited in the General Fund.
