(1) A type B area agency may contract with the Department of Human Services for services of state employees or have such employees transferred to employment by the area agency by transfer agreement.
(2) State employees whose services have been contracted to a type B area agency shall be supervised for program purposes by the area agency.
(3) If state employees are transferred to a type B area agency, the provisions of ORS 236.610 to 236.640 shall apply.
(4) Prior to transfer of any state employee to any other public employer under ORS 410.040 to 410.300, at a date to be determined by the Director of Human Services, each type B area agency shall prepare a plan in coordination with local staff of the department for implementation of ORS 410.040 to 410.300. The plan shall show how statutory responsibilities are to be met and how all staff are to be utilized.
