Upon the adoption of the amendment to Sections 2 and 3 of Article IV of the Constitution of the State of Ohio, the General Assembly shall amend the Revised Code of Ohio to implement the direct appeals of death sentences to the Ohio Supreme Court.
The amendments to Sections 2 and 3 of Article IV of the Constitution of Ohio regarding the direct appeal of a sentence of death apply only to cases in which a sentence of death is imposed for an offense committed on or after January 1, 1995. A direct appeal of a sentence of death imposed for an offense committed prior to January 1, 1995, shall be taken in the same manner as if the amendment had not been adopted.
