1. No person operating a motor vehicle engaged in retail sales of frozen desserts as that term is defined in subdivision thirty-seven of section three hundred seventy-five of this chapter directly to pedestrians shall engage in any such retail sale: (a) unless such motor vehicle is lawfully parked or stopped; (b) to any person, unless such sale occurs from the side of the vehicle away from moving traffic and as near as possible to the curb or shoulder of the roadway; and (c) to any person standing in the roadway.
2. A violation of this section shall be punishable by a fine of not more than fifty dollars.
