1. There is hereby established in the joint custody of the state comptroller and the commissioner of taxation and finance a miscellaneous special revenue account to be known as the “federal-state health reform partnership program account”.
2. The account shall consist of those monies received from the federal government for additional medical assistance revenues or savings achieved under the federal-state health reform partnership program or monies earned by the state and received from the federal government to support expenditures under the federal-state health reform partnership program and/or successor program pursuant to section 1115 of the federal social security act. 1
3. Notwithstanding any provision of law to the contrary, where and to the extent that federal revenues or savings under subdivision two of this section made available to the state under any such New York State section 1115 waiver or amendment thereto, such revenues or savings shall be deposited in the account.
4. All monies shall remain in such account unless otherwise disbursed pursuant to appropriation by the legislature.
