Whenever the tracks of any street surface railway shall be laid upon the side of the roadway of any public highway or street, the headlights of such street surface railway shall be so arranged, adjusted and operated that no dazzling or dangerous beams of light shall be thrown upon the traveling portion of such highway. Whenever the rails of such street surface railway are laid upon any portion of the improved roadway, such headlights shall be so arranged, adjusted and operated that no dangerous or dazzling light, when measured seventy-five feet or more ahead of the lamp or car, shall rise above forty-two inches on the level surface upon which the car stands. Any person or corporation violating the provisions of this section shall be liable to a penalty of one hundred dollars for each day such violation continues.
