There is hereby created and established a transportation district to be known as the Capital District transportation district. This district shall embrace the counties of Albany, Schenectady, Rensselaer, and Saratoga and such of the following counties as may elect to become members by action of their governing bodies as provided in subdivision ten of section thirteen hundred three: Greene, Columbia, Montgomery, Fulton, Warren and any other county included within the upper Hudson planning and development region as designated by the state. The transportation district shall also include all lands and water and all lands under water and all rivers, lakes, bays and harbors within any of the counties of said district.
