As used in this article, the following words and phrases shall have the following meanings:
1. “Retail mercantile establishment” shall mean a place where goods, wares or merchandise are offered to the public for sale.
2. “Restocking fee” shall mean any amount charged by a seller for accepting returned merchandise and paying a refund or credit.
3. “Online retailer” shall mean a seller of goods, wares or merchandise, primarily for personal, family or household purposes, excluding used goods, who offers to consumers in New York such items for sale online through a website, mobile application or other online platform. “Online retailer” shall not include an online marketplace where such marketplace is not the seller.
