Any person or corporation violating any provisions of sections two hundred nine-a, two hundred nine-b and two hundred nine-c shall be liable to a penalty of ten dollars for each day such violation shall continue after sixty days' written notice calling attention to such violation, to be recovered by the aggrieved party. Any person or corporation who has been granted a certificate pursuant to the foregoing provisions hereof which shall not have been thereafter revoked shall have the right of injunction. In any prosecution or action hereunder, the aforesaid certificate of the secretary of state shall be prima facie evidence of the right to the exclusive use of any such name or designation, where proof of such right is necessary.
