If an incarcerated individual escapes from a correctional facility, he or she may be arrested and returned by the superintendent or by an officer or employee of the department or by any peace officer, acting pursuant to his or her special duties, or police officer without a warrant; or a magistrate may cause such escaped incarcerated individual to be arrested and held in custody until he or she can be removed to a correctional facility, as in the case of a commitment.
