Except as otherwise provided in this section and NRS 239.0115, any books, records or other information obtained by the Division of Financial Institutions in connection with an application, complaint, audit, investigation or examination pursuant to this chapter, or in response to a subpoena, are confidential and may be disclosed only to:
1. The Division of Financial Institutions, any authorized employee or representative of the Division of Financial Institutions and any state or federal agency investigating the activities covered under the provisions of this chapter; and
2. Any person if the Commissioner, in his or her discretion, determines that the interests of the public that would be protected by disclosure outweigh the interest of any person in the confidential information not being disclosed.
