A violation of this chapter by a person unlawfully representing himself or herself as a marriage and family therapist, marriage and family therapist intern, clinical professional counselor or clinical professional counselor intern may be enjoined by a district court on petition by the Board. In any such proceeding it is not necessary to show that any person is individually injured. If the respondent is found guilty of misrepresenting himself or herself as a marriage and family therapist, marriage and family therapist intern, clinical professional counselor or clinical professional counselor intern, the court shall enjoin the respondent from making such a representation until the respondent has been licensed. Procedure in those cases is the same as in any other application for an injunction. The remedy by injunction is in addition to criminal prosecution and punishment.
