1. If the Board or the Division determines that a person has violated or is about to violate any provision of this chapter or a regulation adopted pursuant thereto, the Board or Division may bring an action in a court of competent jurisdiction to enjoin the person from engaging in or continuing the violation.
2. An injunction:
(a) May be issued without proof of actual damage sustained by any person.
(b) Does not prohibit the criminal prosecution and punishment of the person who commits the violation.
