“Fluid milk” means any milk product in fluid or frozen form containing less than 9 percent butterfat, including, without limitation, milk, fat-free milk, low-fat milk, light milk, reduced-fat milk, eggnog and cultured buttermilk. The term does not include any:
1. Evaporated or condensed milk;
2. Formula for infants or for dietary use that is packaged in a hermetically sealed container; or
3. Product which contains less than 6.5 percent nonfat milk solids and whey.
