A disposal site established by a municipality for which no person is employed to control access to and use of the site may be used only for the disposal of solid waste by:
1. The residents of the municipality; or
2. Tourists in the area for noncommercial reasons.
Any person violating the provisions of this section is guilty of a misdemeanor.
