“Outdoor youth program” means a program for the provision of services, while living outdoors, to persons under 18 years of age who have behavioral problems, problems with mental health or problems with substance use disorders. The term does not include any facility, activity or program:
1. Operated by or on behalf of a governmental entity; or
2. Licensed by the Division of the Department.
