If any district attorney shall fail or refuse to pay any money collected by him or her for taxes to the county treasurer as provided in this chapter, the district attorney shall:
1. Forfeit his or her office and shall be removed forthwith therefrom; and
2. Be guilty of a gross misdemeanor.
