New Mexico Statutes Chapter 62. Electric, Gas and Water Utilities § 62-18-23. Applicability

The provisions of the Energy Transition Act shall not apply to a qualifying utility that makes an initial application for a financing order more than twelve years after the effective date of that act. This section shall not preclude a qualifying utility for which the commission has issued a financing order from applying to the commission for a subsequent order amending the financing order, pursuant to Section 7 of the Energy Transition Act.
